Rules to an upgrade:

• Currently available to DISH Network residential customers.
• No equipment to buy.
  
• Limit of two (2) receivers and four (4) tuners per DISH’n It Up transaction.
  
• Limit of one (1) DISH’n It Up transaction per twelve (12) month period once customer has one or more MPEG-4 or ViP-series HD receivers.
  
• A twenty-four (24) month term agreement applies under all plans.
  
• Maximum of four (4) total leased tuners per account (including previously-leased tuners).
  
• Standard professional installation of up to two (2) receivers and four (4) tuners is included under all DISH’n It Up plans.
  
• A $5.00 per month equipment rental fee applies for each model 301, 381, 311, 510, 322, 522, or 625 receiver added to a subscriber’s account.
  
• A $7.00 per month equipment rental fee applies for each HD receiver (model ViP211, 411,
  ViP222, ViP612 DVR, ViP622 DVR and ViP722 DVR receivers) added to a subscriber’s account.
• A $5.00 per month additional outlet programming access fee will be charged to each
  customer’s account for each dual-tuner receiver (model 322, ViP222, 522, 625, ViP622 DVR or ViP722 DVR). This fee will be waived on a monthly basis for each such receiver that DISH Network confirms has been continuously connected to such customer’s land-based phone line and/or (solely in the case of a model ViP622 DVR or ViP 722 DVR) continuously connected to such customer’s same broadband home network resulting in the functionality of the applicable receiver’s Internet based features. DISH Network’s confirmation process shall be the sole method utilized to determine if a customer’s additional outlet programming access fee(s) will be waived.
• A $5.98 per month DISH Network DVR service fee applies to each model 510, 522, 625,
  ViP612 DVR, ViP622 DVR or ViP722 DVR receiver activated. This fee will not apply with respect to one (1) such receiver if the customer subscribes to DishDVR Advantage and will be waived if the customer subscribes to America’s “Everything Pak”.
  
• Non-refundable Upgrade Charges and Installation Fees are payable to the retailer.
  
• Customers must return receivers leased under this Promotional Program to DISH Network within fifteen (15) days after they terminate their DISH’n It Up Promotion Agreement or downgrade their programming below Eligible Residential Programming (as defined in the Incentive Payment Structure Business Rules), or their service is disconnected for any reason, or they will be assessed an unreturned equipment charge as follows: model ViP722 DVR receivers, $425.00; model ViP622 DVR receivers, $350.00; model ViP612 DVR and 522 receivers, $300.00; model 625 receivers, $275.00; model ViP222 receivers, $250.00; model ViP211 and 411 receivers, $175.00; model 322 receivers, $125.00; model 311 receivers, $75.00; model 301 and 381 receivers $50.00; outdoor LNBF and quad switch, $50.00.
  
• Customers who return a currently-activated DISH Network receiver owned by them in exchange for a receiver provided under this Promotional Program, will receive a $10.00 credit on their DISH Network account. The credit will be applied after the receiver the customer is returning has been received and processed by DISH Network. In order to be eligible for the $10.00 credit for exchange of an owned receiver(s), such receiver(s) must be received by DISH Network within forty-five (45) days of deactivation. A maximum of three (3) tuners may be returned for a credit of $10.00 each.
  
• Customers who exchange a DISH Network receiver previously leased by them for a receiver provided under this Promotional Program must return their previously-leased receiver directly to DISH Network. No credits will be issued for an exchange of a previously-leased receiver.
  
• Upon notification to DISH Network that a qualifying customer intends to exchange a receiver(s) and systematic confirmation that such receiver(s) have been deactivated, DISH Network will generally send such customer a postage pre-paid box(es) in which to ship such receiver(s) back to DISH Network.
  
• Each customer is responsible for returning his or her owned or leased DISH Network equipment. Retailers may not and should not offer to return equipment on a customer’s behalf.
  
• Ownership of receivers, smart cards, and remote controls provided under this Promotional Program shall be determined by the DISH’n It Up Promotional Program agreement signed between the customer and DISH Network. Ownership and any return requirements for LNBF’s and switches delivered to a customer under a prior promotional agreement(s) with DISH Network shall be governed by the terms and conditions of such prior promotional agreement(s).
  
• DISH shall determine customer eligibility to participate in this Promotional Program at Any Time in its Sole Discretion.
